This Privacy Policy explains how Prestige Black Rentals collects, uses, and discloses your information when you use our website, forms, and services.
PRESTIGE BLACK RENTALS - PRIVACY POLICY

INTRODUCTION
Prestige Black Rentals ("Prestige Black," "we," "us," or "our") operates
this store and website, our booking platform, and our mobile apps, and
provides luxury vehicle rental, chauffeur, and luxury event services (together, the
"Services"). Our online store is powered by Shopify.
This Privacy Policy describes how we collect, use, and disclose your
personal information when you visit, use, or make a booking or other
transaction using the Services, or otherwise communicate with us. If there
is a conflict between our Terms of Service and this Privacy Policy, this
Privacy Policy controls with respect to the collection, processing, and
disclosure of your personal information.
Please read this Privacy Policy carefully. By using the Services, you
acknowledge that you have read and understand it.
PERSONAL INFORMATION WE COLLECT OR PROCESS
"Personal information" means information that identifies or can reasonably
be linked to you. It does not include information collected anonymously or
de-identified so it cannot reasonably be linked to you. Depending on how you
interact with the Services, we may collect or process:
- Contact details - name, postal address, billing/shipping address,
phone number, and email address.
- Financial information - payment card and financial account information,
transaction details, form of payment, and payment confirmations.
(Card numbers are handled by our payment processor; see "Payment and
Verification Processors.")
- Account information - username, password, preferences, and settings.
- Booking and transaction information - vehicles and services you view,
reserve, rent, cancel, or pay for, and your booking history.
- Government identifiers and identity-verification data - your driver's
license or government-issued photo ID, and a self-photo ("selfie"),
collected to verify your identity, age, and eligibility to drive (see
"Identity and Biometric Verification" and "Driver's License and Driving
Record").
- Insurance information - your insurer, policy number, and coverage.
- Precise geolocation (sensitive) - real-time and historical GPS/telematics
location of the vehicle and of an active trip (see "Location and In-Vehicle
/ Ride Tracking").
- Biometric/identity data (sensitive) - facial-geometry data created when
our verification provider compares your selfie to your ID (see "Identity
and Biometric Verification").
- Audiovisual data - pre-trip and post-trip photos and videos of the
vehicle, event photos and videos, and any media you upload.
- Communications - the content of your messages with us (SMS, email,
calls, and support inquiries).
- Device and usage information - device, browser, IP address, unique
identifiers, and how you interact with the Services.
We treat precise geolocation and identity/biometric data as SENSITIVE
information and, where required by law, collect them only with your consent
(see "Your Consent to Process Sensitive Data").
SOURCES OF PERSONAL INFORMATION
We collect personal information: directly from you; automatically through
the Services (including cookies and similar technologies and vehicle/app
telematics); from our service providers (such as our payment/identity
processor and dispatch platform); and from our partners or other third
parties, including, where applicable, motor-vehicle records.
HOW WE USE YOUR PERSONAL INFORMATION
- Provide, tailor, and improve the Services - perform our contract with
you, process payments and deposits, verify identity and eligibility,
fulfill and document rentals and chauffeur trips, provide dispatch and
live trip support, manage your account, and create a customized
experience.
- Marketing and advertising - send promotional messages by email, text,
or mail (only as permitted below), and, where you consent, show you
relevant advertising.
- Security and fraud prevention - authenticate you, secure payments,
prevent and investigate fraud, theft, and misuse, recover vehicles, and
protect people and property.
- Communicate with you - provide customer support and respond to inquiries.
- Legal reasons - comply with law, respond to legal requests, and enforce
our terms.
This policy describes our real data practices: we collect, use, and share
personal information only as described here, and we DO NOT SELL your personal
information. If our practices change, we will update this policy and, where
required, obtain your consent.
COOKIES AND TRACKING TECHNOLOGIES
We use cookies, pixels, tags, web beacons, local storage, and tracking
tools built into our apps ("Tracking Technologies"), some ours and some operated by third parties, to
run and secure the site, remember your preferences, measure performance,
and - where you consent - deliver and measure advertising. Categories:
- Strictly necessary - required to load the site, sign you in, secure your
session, process payments, and prevent fraud. These cannot be switched
off.
- Preferences and functionality - remember choices like language or saved
details.
- Analytics and performance - help us understand and improve the booking
experience. Providers include Shopify.
- Advertising and measurement - help us and our partners measure and, where
permitted, deliver ads. Providers include Google Ads (conversion measurement). These partners may set their own cookies and
receive device/browser data, IP address, and pages/actions you view.
Prior consent. Where required by law, we obtain your consent BEFORE
non-essential Tracking Technologies (including advertising/analytics pixels
and any session-recording or live-chat tools) are activated. Strictly
necessary technologies do not require consent.
Managing cookies. You can accept, reject, or manage non-essential Tracking
Technologies through our cookie banner and your browser and device settings. Rejecting them will not affect your ability
to book core Services.
Do Not Track and Global Privacy Control. Because there is no industry-standard
response to browser "Do Not Track" signals, our site does not currently
respond to them. However, if your browser sends a recognized universal
opt-out preference signal such as the Global Privacy Control (GPC), we treat
it as a valid request to opt that browser or device out of any "sale" or
"sharing" of personal information and out of targeted advertising, to the
extent required by law. Because these signals are device-specific, you may
need to set them on each browser or device you use.
AUTOMATED TEXT MESSAGES (SMS/MMS)
We operate two text programs: (1) Service/transactional messages -
reservation confirmations, secure payment links, and pickup, return, and
balance-due reminders, sent to the number you provide for your booking; and
(2) Marketing messages - promotions and offers, sent only if you separately
opt in.
- Consent. We send automated marketing texts only after you give prior
express written consent through a separate opt-in, and that consent is
NOT a condition of renting a vehicle, booking a ride, or purchasing
anything from us. You may still receive service messages about a
transaction you initiated even if you have not opted in to marketing.
- Message frequency. Service message frequency depends on your reservation
activity. Marketing message frequency varies (for example, up to 6
messages per month).
- Rates. Message and data rates may apply, depending on your mobile plan.
We do not charge you for the texts; your carrier's standard rates apply.
Carriers are not liable for delayed or undelivered messages.
- HELP / opt-out. Text HELP for help, or contact us at (214) 207-2481 /
prestigeblackcorp@gmail.com. You can revoke consent at any time by any
reasonable means - including by replying STOP, QUIT, END, CANCEL,
UNSUBSCRIBE, OPT OUT, or REVOKE to any text - and we will stop sending
texts to that number within a reasonable time, not to exceed 10 business
days. We may send one confirmation that you have opted out. Opting out of
texts will not stop email or phone contact necessary to complete an
active reservation.
MARKETING EMAIL
Our commercial emails identify themselves as promotional, include our valid
physical mailing address, and provide a working way to unsubscribe. We do not
use false or misleading "From," "To," or subject lines. If you unsubscribe,
we stop sending promotional email to that address within 10 business days.
We may still send transactional emails (confirmations, receipts, reservation
notices) about an active or past transaction.
LOCATION AND IN-VEHICLE / RIDE TRACKING (PLEASE READ CAREFULLY)
Because we rent high-value vehicles and provide chauffeured rides, location
information is part of how we operate safely. Our vehicles and our rider and
driver apps use GPS and telematics that collect PRECISE, real-time and
historical location data. When you rent a vehicle or take a chauffeured ride,
the location of the vehicle and/or trip may be tracked continuously for the
duration of the rental or ride. This data can include latitude/longitude,
routes, stops, speed, mileage, and time stamps.
Why we collect it. To dispatch and route trips; provide live trip tracking
and arrival times; support safety and emergency response; locate and recover
a vehicle that is stolen, not returned, or taken outside an authorized area;
calculate mileage, tolls, fuel, and charges; and investigate incidents,
accidents, damage, and disputes.
We treat precise geolocation as sensitive. We do NOT sell your location data
and do NOT share it with data brokers. We share it only with service
providers who help us operate (such as mapping, dispatch, and telematics
vendors) and with insurers, law enforcement, or courts when reasonably
necessary for safety, vehicle recovery, claims, or legal process, or as the
law permits. We retain trip location data for as long as needed for billing, safety, insurance, and dispute resolution,
and then delete or de-identify it.
Your choices. You can turn off device location sharing in your phone
settings, but doing so may prevent us from providing part or all of the
Service (for example, dispatching a car to you). Location recorded by a GPS
or telematics device installed in a rented vehicle is part of operating that
vehicle and is described in your rental agreement. Because tracking is an
integral part of our rental and chauffeur service, if you do not want the
vehicle or ride tracked, please do not rent or book with us.
IDENTITY AND BIOMETRIC VERIFICATION (ID DOCUMENT AND SELFIE)
To confirm your identity and age, prevent fraud, and meet our insurance and
legal obligations, we use Stripe Identity to verify your government-issued
driver's license or photo ID together with a selfie. You may be asked to
upload or capture an image of your ID and a photo of your face, which the
provider compares to confirm a match. This comparison may create a
facial-geometry (biometric) record used solely to complete the
verification.
- We do NOT use this information to build a facial-recognition database,
and we do NOT sell it. Stripe performs the comparison as our service
provider under its own privacy terms; we receive the verification result
and a copy of your submitted ID and image.
- We use this information solely to verify your identity, age, and
eligibility, to detect fraud, and to meet insurance and legal obligations.
- Consent. Where the law requires your consent to capture or use biometric
information (for example, under the Texas Capture or Use of Biometric
Identifier Act), we obtain your affirmative consent BEFORE verification.
- Retention. We and our provider retain biometric identifiers created for
verification only as long as needed for these purposes and, consistent
with Texas law, destroy them within a reasonable time and no later than
ONE YEAR after your verification need ends. We keep other verification
records only as needed to document eligibility, resolve disputes, and
comply with law.
DRIVER'S LICENSE AND DRIVING RECORD
To rent or drive our vehicles, we collect and verify your driver's license
and related driver information - including license number, class, expiration,
restrictions, and, where applicable, your driving history or motor-vehicle
record. We use it only to (i) confirm your identity and legal eligibility to
drive, (ii) meet insurance, safety, and legal obligations, (iii) prevent
fraud and vehicle theft, (iv) enforce our rental agreement, including
recovering a vehicle or amounts you owe, and (v) respond to lawful requests
from courts, law enforcement, insurers, and toll or citation authorities.
When we obtain your driving record from a state motor-vehicle department or a
motor-vehicle-record provider, that information is protected by the federal
Driver's Privacy Protection Act (18 U.S.C. Sections 2721-2725). We request
and use it only for purposes the Act permits, and we do not sell or
re-disclose it except as the Act allows. We limit access to license and
driving-record data to staff who need it and safeguard it against
unauthorized access.
If you add authorized or additional drivers to a rental, we collect and
verify the same identity, driver's license, driving-record, and
identity/biometric-verification information for each of them. You are
responsible for confirming that each additional driver has read this Privacy
Policy and has given the biometric and location consents described here before
you add them.
INSURANCE, TOLLS, CITATIONS, AND VEHICLE-CONDITION MEDIA
We collect your insurance information to confirm coverage and process claims.
We collect and keep pre-trip and post-trip photos and videos of our vehicles,
and any media you upload, to document condition, mileage, and fuel, and to
support billing, damage assessment, and dispute resolution. If a vehicle
incurs tolls, citations, red-light or speed-camera violations, or similar
charges during your rental or ride, we and our toll/citation processors may
receive and process the related records. We may then pass those charges on to
you, plus any administrative fee disclosed in your rental agreement. We may share insurance, toll/citation, and
vehicle-condition information with insurers, toll and citation authorities,
law enforcement, and courts as reasonably necessary to process claims, comply
with law, or resolve disputes.
HOW WE DISCLOSE PERSONAL INFORMATION
We may share personal information: with Shopify; with service providers who
act on our behalf (payment/identity processing, dispatch, hosting, analytics,
IT, and customer support); with insurers; with advertising and analytics
partners, only for the limited advertising and measurement described in
"Cookies and Tracking Technologies" and subject to your opt-out; when you ask
us to; with affiliates within our corporate group; and in connection with
legal obligations, investigations, safety, vehicle recovery, or a business
transaction. We do not sell your personal information.
SERVICE PROVIDERS AND TECHNOLOGY WE USE
We rely on the following service providers and technologies to operate the
Services. Each processes personal information only as needed to provide
services to us, under its own agreement and privacy terms, and we do not sell
your personal information to them:
- Shopify - our online storefront, checkout, and commerce analytics.
- Stripe, Inc. - payment processing, security-deposit holds, and identity
verification (Stripe Identity).
- Cloudflare, Inc. - our application back-end (Cloudflare Workers) and
secure storage of trip videos (Cloudflare R2).
- Google Firebase (Google LLC) - secure database storage and synchronization
of booking, account, and trip data.
- GitHub Pages (GitHub, Inc.) - hosting of our web and mobile apps
(management dashboard, rider app, driver app, and client portal).
- Resend - delivery of our transactional and marketing email.
- Twilio - delivery of our text (SMS) messages.
- Google (Google LLC) - Google Ads conversion measurement, and Google Maps
Platform / Places for address lookup, mapping, and navigation.
- OpenStreetMap, OSRM, and Photon - map tiles, routing, and address search.
- Apple and Google push-notification services - delivery of app
notifications.
- OpenAI and Anthropic - AI tools we may use to help draft our marketing
email content (we do not send them your identity, payment, or location
data).
We also store records in our own secure cloud infrastructure and on authorized
devices running our management dashboard, as described in "How Long We Keep
Your Information."
PAYMENT AND VERIFICATION PROCESSORS (STRIPE)
We use Stripe, Inc. to process payments and to verify identity (Stripe
Identity). Card numbers and payment credentials are transmitted directly to
and stored by Stripe, a PCI-DSS Level 1 certified processor (currently
PCI-DSS v4.0.1); Prestige Black does not store your full card number on our
own systems. For an authorized security-deposit hold, Stripe may retain your
card credential to place or release the hold. Stripe handles this information
for us as our service provider and, for its own legal, fraud-prevention, and
compliance purposes, also uses certain data on its own (as an independent
controller). Stripe may use its own trusted vendors (sub-processors) to do
this. See Stripe's privacy
policy at stripe.com/privacy. We maintain reasonable safeguards for the
payment-related information we handle and limit access to personnel who need
it.
SALE / SHARING OF PERSONAL INFORMATION
We DO NOT sell your personal data, sensitive data, or biometric data for
money or other valuable consideration, and we do not process your data for
profiling that produces legal or similarly significant effects about you.
Identity-verification and rental-eligibility decisions are not made solely by
automated means; our staff review verification results and can override them.
Where our advertising cookies constitute "targeted advertising" or a "share"
under applicable law, you may opt out as described in "Your Rights and
Choices" and by using the Global Privacy Control signal.
YOUR CONSENT TO PROCESS SENSITIVE DATA
Because live GPS location and identity/biometric verification are "sensitive
data," we ask for your clear, affirmative, opt-in consent before collecting
them where required. At booking you will see a separate, unchecked checkbox:
[ ] I consent to Prestige Black Rentals collecting my precise GPS location
during my active rental or chauffeur trip, and to identity verification
that matches a selfie to my government-issued ID, as described in this
Privacy Policy.
You may withdraw consent by emailing prestigeblackcorp@gmail.com; withdrawal
does not affect processing already performed and may prevent us from
providing the Service.
YOUR RIGHTS AND CHOICES
Depending on where you live, you may have rights to access, delete, correct,
and obtain a copy (portability) of your personal information, and to opt out
of targeted advertising, the sale of personal data, and certain profiling.

(214) 207-2481. We may need to verify your identity before acting on a
request.
Your Texas Privacy Rights. If you are a Texas resident, the Texas Data
Privacy and Security Act (Tex. Bus. & Com. Code Ch. 541) gives you the right
to: confirm whether we process your personal data and access it; correct
inaccuracies; delete personal data; obtain a portable copy of data you
provided; and opt out of (a) targeted advertising, (b) the sale of personal
data, and (c) profiling with legal or similarly significant effects. Email
prestigeblackcorp@gmail.com with the subject line "Texas Privacy Request." We
will respond within 45 days (extendable once by 45 days with notice) and you
may exercise these rights free of charge up to twice per year. You may use an
authorized agent to submit a request to opt out of targeted advertising or the
sale of your personal data; we may require proof of the agent's written
authorization and may still verify your identity.
Right to Appeal. If we decline your request, we will tell you why. You may
appeal by replying to our decision email with the subject line "Privacy
Appeal." We will inform you in writing of our appeal decision within 60 days.
If we deny the appeal, we will provide you a way to submit a complaint to the
Texas Attorney General (texasattorneygeneral.gov).
Other states. If you reside in another state with a comprehensive privacy law,
similar rights may apply; contact us to exercise them.
RELATIONSHIP WITH SHOPIFY
The Services are hosted by Shopify, which collects and processes personal
information about your use of the Services to provide and improve them. To
learn more, visit https://privacy.shopify.com/en.
THIRD-PARTY WEBSITES AND LINKS
The Services may link to third-party websites. We are not responsible for the
privacy practices of those external sites.
CHILDREN'S PRIVACY
Our Services are intended for adults. You must be at least 18 to use our
website and apps, and renters and drivers must meet the higher minimum age in
the rental agreement. Our Services are not directed to children, and we do
not knowingly collect personal information from children under 13. If we learn
we have collected such information without required parental consent, we will
delete it promptly. Additional rights may apply to consumers ages 13-15 under
certain state privacy laws. If you believe a child under 13 has provided us

DATA SECURITY
We maintain administrative, technical, and physical safeguards designed to
protect personal information, appropriate to its nature and the risks
involved. Payment card data is handled by our PCI-DSS-compliant processor
(Stripe), and we do not store full payment card numbers on our systems. No
method of transmission or storage is completely secure, and we cannot
guarantee absolute security. You are responsible for keeping your account
credentials confidential.
DATA BREACH NOTIFICATION
If a security incident compromises your sensitive personal information, we
will investigate and notify affected individuals and the applicable regulators
when the law requires - including under the Texas Identity Theft Enforcement
and Protection Act (Tex. Bus. & Com. Code Ch. 521). For breaches subject to
Texas law, we will notify affected Texas residents no later than 60 days after
we determine the breach occurred, and notify the Texas Attorney General no
later than 30 days after that determination if the breach affects at least 250
Texas residents. We will act without unreasonable delay, and our notice will
describe, to the extent known, what happened, the information involved, and
steps you can take.
HOW LONG WE KEEP YOUR INFORMATION
We keep personal information for as long as needed for the purposes described
in this policy and to meet our legal, tax, insurance, and dispute-resolution
obligations, and then we delete or de-identify it. We store records under our
control in our secure cloud infrastructure (provided by Cloudflare and Google
Firebase) and/or on authorized devices running our management dashboard.
Specifically:
- Booking, contract, transaction, communication, and account records - kept
for the length of your relationship with us and afterward for as long as
needed for our tax, accounting, insurance, safety, and legal obligations.
- Payment information - we do not store full card numbers; limited records
(such as the last four digits and payment status) are kept for the period
above.
- Identity documents and selfies - kept only as long as needed to verify you
and protect against fraud and disputes; biometric identifiers created for
verification are destroyed within a reasonable time and no later than ONE
YEAR after your verification need ends (or sooner per our provider), as
required by Texas law.
- Location, trip/telematics data, and pre-/post-trip photos and videos -
kept for as long as needed for billing, safety, insurance, and dispute
resolution, and longer if tied to an open claim or legal matter, then
deleted or de-identified.
- Marketing consent and opt-out records - kept so we can honor your choices
and show we had your permission.
Information tied to an open dispute, claim, investigation, audit, or legal
hold is kept until that matter resolves. Information may remain in secure
backups for a limited time before it is overwritten.
INTERNATIONAL TRANSFERS
Your personal information may be transferred, stored, and processed outside
your country, including in the United States.
CHANGES TO THIS PRIVACY POLICY
We may update this Privacy Policy from time to time to reflect operational,
legal, or regulatory changes. We will update the "Last Updated" date and,
where required, obtain your consent.
